Pleasure boating is regulated by the Italian Pleasure Boating Code.
The Code defines recreational navigation as that carried out in maritime or inland waters for sporting or recreational purposes and not for profit.
As far as recreational navigation means are concerned, a distinction must be made between those used for private use and those used for commercial use.
The private use of means for pleasure navigation occurs when a pleasure craft is used by natural persons for navigation in maritime or inland waters for sporting or recreational purposes and for non-profit purposes.
The commercial use of pleasure navigation means occurs when a pleasure craft is used for profit by natural or legal persons who own it, but is still used by natural persons who have the possession or detention for navigation in maritime or inland waters for sporting or recreational and non-profit purposes.

Naturally, the distinction between private and commercial use of navigation means is of fundamental importance in establishing the applicable regime from a civil, administrative and fiscal point of view.
